Informative in compliance to Italian Legislative Decree “196/2003” about personal data treatment

We inform you that any personal data of yours we might have recorded as supplied by you, as well as differently received still in conformity to Italian laws and in conformity to particular existing agreement if any, are processed with full care to their protection, correctness, legality and transparency.

Duralamp files and processes these data only in order to fulfill its contractual obligations to you or only to respect all the professional relations and tasks with you existing. These obligations and relations may be or may arise from our professional activity whose some items are herein listed just as a non-exhaustive series of examples: sales or purchase of lamps or similar, commercial and/or technical assistance also in after-sale service, supplying or procurement of services or facilities or goods related to our business activity.

Duralamp files data strictly when appropriately concerning the needs and tasks quoted above and refrain from using and filing other not accordant data

Data processing, whereas terms “processing” has been defined by the article 4 of the Decree n.196/2003, is done by means of manual or electronic procedures, with utmost care in safety protection measures, thus conforming what required by Italian Laws.

Transmission of your data to Duralamp is done on voluntary base but it has to be known that in case of denial of these information, as well as a request for these data cancellation from our data bases as you have fully right to ask, might involve our not being capable to fulfill our contractual and professional duties toward you as well as the impossibility to carry on a professional intercourse with you.

Personal data concerning you might be transmitted to other Parts, as other Companies controlling Duralamp or controlled by Duralamp or tied to Duralamp by functional professional relation, even outside the Italian territory, to perform the activities pursuant to which the data have been collected.

Conforming to the Italian laws, we declare that Duralamp SpA Società Unipersonale, via Pratese 164, 50143 Firenze is the “data controller”.

We inform you that the section 7 of the Decree 196/2003, which follows, gives you the following rights over the Company processing your personal data, more precisely over the “data controller” as formerly defined.

Section 7

(Right to Access Personal Data and Other Rights)

1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.

2. A data subject shall have the right to be informed

a) of the source of the personal data;

b) of the purposes and methods of the processing;

c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;

d) of the identification data concerning data controller, data processors and the representative designate

d as per Section 5(2);

e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

3. A data subject shall have the right to obtain

a) updating, rectification or, where interested therein, integration of the data;

b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;

c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.

4. A data subject shall have the right to object, in whole or in part,

a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;

b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication survey.
